Paul Welten (1974) has broad experience of the private law-related aspects of construction and property law. His particular focus is on business involving various kinds of government bodies. Paul’s clients include large public authorities, housing associations and water boards as well as major contractors, investors and project developers.
One of his specialities in the field of construction law is the limitation of risks associated with the implementation phase of major public authority construction projects. Issues include handling questions of liability, the suspension of building works, resolving financial disputes and risk management. Paul also has considerable experience of litigation via the construction arbitration council (Raad van Arbitrage voor de Bouw), the Netherlands Arbitration Institute (NAI) and in Dutch courts where he acts on behalf of commissioning parties (including public authorities) as well as for contractors.
Additionally, he is involved in drawing up complex construction contracts and legal provisions for the design, construction, financing, management and/or maintenance of major construction works. These agreements are either tailor-made or based on DNR 2005 and/or the uniform administrative conditions for the conduct of works (UAV 1989) or the uniform administrative conditions for integrated forms of contracts (UAV-GC 2005). Paul has, for instance, devised DBM(F)O contracts for the financing, development and maintenance of so-called brede scholen in which activities by a wide range of organisations are devoted to children’s development.
On a day-to-day level, Paul focuses on arranging the entire range of contracts needed in successfully completing large-scale housing and utility construction projects.
In the area of property law, he handles contracts for property transactions and project development particularly public-private partnerships. Work on behalf of clients, frequently those in the public sector, has included conducting negotiations and drawing up agreements in highly complex and extensive property developments in the Netherlands. On cases of this kind, he often works in close co-operation with other sections of AKD, chiefly Administrative Law, European and Competition Law and Corporate Law.
Paul frequently gives internal and external lectures on the UAV 1989 (including for Vermande) and the UAV- GC 2005. He is a member of the construction law association and the association of construction law lawyers.
