Barend Post (1967) is a partner in the banking and finance team. He previously worked at Stibbe, Houthoff Buruma and Andersen Legal (Wouters Advocaten). In 1996, Barend obtained an LL.M in the field of American corporate and securities law at Duke University (NC), in the United States.
Barend has an industry-driven approach. He generally works with taxation and financial advisers and with his colleagues from a variety of disciplines (property, administrative law, etc.). He concentrates primarily on financing in the following areas:
1. Cure and care
In recent years, he has been extensively involved in structuring and financing building projects in the hospital healthcare sector (including new buildings, conversions, renovations and letting). His role here is not restricted to setting down the contractual agreements between the relevant parties. He is frequently involved with projects from the very beginning, advising clients in the coordination and management of their financing programmes from beginning to end, from the kick-off meeting all the way to the financial close. As a result of a number of consultancy assignments with the Association of Tertiary Medical Teaching Hospitals and regular hospitals, Barend has acquired considerable knowledge of the healthcare sector, healthcare legislation, how hospitals function and the internal relationships that exist within hospitals. In addition to healthcare institutions themselves, he regularly assists government bodies involved with healthcare institutions in dealing with financing issues.
Barend is also involved with the private healthcare sector. This includes the setting up and structuring of chains of independent treatment centres and dental practices, advising both the healthcare institutions themselves and investors, such as private equity funds.
2. Property
Together with the AKD’s notarial office for property, he regularly acts on behalf of housing corporations facing financing issues. His focus also lies on the financing of properties that are operated for a particular purpose, including hotels, holiday parks, supermarkets, etc.
3. Renewable energy
His third area of activity is that of renewable energy - wind and solar energy, PKK fraction, biofermentation installations, pig manure, ethanol, Carbon Emission Rights, etc., for projects both in and outside the Netherlands. Here, too, Barend is generally involved with the projects right from the start.
4. Funds
Finally, he has extensive involvement with the setting up of funds, whether it be fund of funds, feeder funds, UCITS (funds with a European passport), private equity funds, hedge funds, Dutch or foreign property funds, ships, films, wind farms, Mortgage Backed Securities, etc.
Clients appreciate Barend on account of his pragmatic and creative approach, and consider him to be highly competent in the field of securities law:
European Legal 500, 2005: 'AKD Prinsen Van Wijmen has consolidated its banking practice in Amsterdam under Barend Post, who clients praise for having 'an excellent knowledge of securities law'.
European Legal 500, 2007: 'The practice is engaged in leveraged financings. It is credited for its 'personal touch, great involvement and good availability', while practice head Barend Post is praised for 'solving problems in a practical way'. The firm is also involved in structuring investment funds and is described as 'very creative' in this respect'.
