Non-competition clauses

Non-competition clauses have lately become more and more an issue in the courts, and considering the recent developments in the labour market as a result of the current economic downturn, it is only logical for businesses to want to protect their business interests.

Validity
Under these conditions, it has become more difficult for employees to get out of non-competition clauses. Provided of course that such clauses have been drawn up properly and have not become invalid. Is that the case with your non-competition clauses? And do these clauses sufficiently limit the options open to key members of your staff to start competing with you after they leave your employment? Do these restrictions in fact still apply? If you want to be sure, don't hesitate to contact one of our employment law specialists to obtain clear and comprehensive advice.

No non-competition clause?
If you have not concluded a non-competition clause, our legal system still provides you with the option of tackling unlawful competition on the part of former employees. Our employment law specialists will be very pleased to help you in this respect as well.
