Insight into potential liability
It is advisable to obtain a clear picture of the different types of potential liability that your company may encounter. Examples of this include the following:
 

  • Corporate guarantees, security deposits/contracts of suretyship, group financing, support letters and declarations to maintain.
  • Has exemption from publication been granted in connection with the annual accounts? Has this exemption been applied in the correct manner, and what risks are involved?
  • Have declarations of liability (known as '403 declarations') been issued within a group structure? Should you consider revoking these 403 declarations, and if so, when?
