SHB Banenpool
François Defaix and Pieter Huys of AKD’s Employment Law practice group collaborated with AKD’s Insolvency practice group to assist in the company re-launch following on the bankruptcy of SHB Banenpool.
This assistance mainly focused on the changes made to and the
drafting of a new collective labour agreement for SHB
Banenpool.
One crucial factor was that many of SHB Banenpool's former
employees had long-term employment and had therefore built up the
corresponding seniority. At the same time, in the new collective
labour agreement maximum flexible employability had to be sought. A
considerable degree of flexibility was attained by making intensive
use of the options provided under the Collective Agreements Act
