Flex-IN
This temporary employment agency for national and international truck drivers unexpectedly faced obligatory registration (with retroactive force) with the Sectoral Pension Fund for the Road Haulage Sector (‘BGV’).
This pension fund imposed extremely heavy contribution notices
on Flex-IN, and the agency's previous registration with the StiPP
Employment Agency Sectoral Pension Fund (formerly known as Stiplu),
which was considerably cheaper, was simultaneously terminated with
retroactive force as well. One remarkable feature here was that
StiPP and BGV shared the same administrator, i.e. Syntrus
Achmea.
François Defaix and Gerdien van der Voet of AKD's Employment Law
practice group submitted objections to the contribution notices
imposed on Flex-IN. As a result of these objections, the
administrator resolved to allow Flex-IN to maintain its
registration with the cheaper StiPP Employment Agency Sectoral
Pension Fund, and to cancel the heavy contribution notices relating
to the agency's registration with BGV.
